2. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Services Provided

MyPaw is a platform that connects pet owners with third-party service providers ("Partners"). Our services include, but are not limited to:

• Scheduling appointments with veterinary, grooming, and other pet care Partners.
• A marketplace for pet products.
• Community features such as discussion boards and pet matchmaking.
• Tools for managing your pet’s health records.

All services provided by Partners are subject to their availability and their own terms and conditions. MyPaw is not responsible for the services provided by Partners.

4. User Content

You may post content, including photos, text, and other information related to your pets ("User Content"). You retain ownership of your User Content, but by posting it, you grant MyPaw a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content in connection with providing and promoting the Service. You are solely responsible for your User Content and the consequences of posting it.

5. User Conduct and Responsibilities

You agree to use the Service responsibly and agree not to:

• Provide false or misleading information about yourself or your pets.
• Violate any applicable laws or regulations.
• Infringe on the rights of any third party, including intellectual property and privacy rights.
• Harass, abuse, or harm another person or pet.
• Use the Service for any commercial purpose without our prior written consent.

6. Payments, Cancellations, and Refunds

Fees for services and products are due at the time of purchase. All payments are processed through our third-party payment processor. Refund policies for services are determined by the individual Partners. For products purchased through MyPaw, our refund policy will apply. Missed appointments or late cancellations may be non-refundable as per the Partner's policy.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MYPAW DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MYPAW IS A PLATFORM. WE ARE NOT A VETERINARY PROVIDER, GROOMER, OR RETAILER. WE ARE NOT LIABLE FOR THE ACTS, OMISSIONS, OR CONDUCT OF ANY PARTNERS OR OTHER USERS OF THE SERVICE. IN NO EVENT SHALL MYPAW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

8. Indemnification

You agree to defend, indemnify, and hold harmless MyPaw, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

9. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

10. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Niagara County, New York to resolve any dispute or claim arising from these Terms.
